STATUTES OF LIMITATIONS IN CRIMINAL CASES In most Colorado cases, prosecutors have a limited amount of time after a crime occurs to press charges. And if their time runs out, then you can no longer be prosecuted for that particular offense. In general, the D.A. has six months to prosecute petty offenses, eighteen months to prosecute misdemeanors, and 3 years to prosecute felonies. But certain felonies have a longer statute of limitations. For example, vehicular homicide must be prosecuted within five years of the incident, or if there was also a hit and run, within 10 years. And some felonies have no statutes of limitations at all, which means prosecutors can press charges no matter how much time has gone by. These crimes include murder, kidnapping, and sex crimes against a child.
