Every scheme has by-laws, but not all by-laws are created equally. Some schemes' by-laws are short, others are long, some are valid, and others are invalid.
Although bodies corporate have the option to adopt the standard and default by-laws in the legislation, many don't, opting for their own "bespoke" set. There is a broad array of how a scheme's by-laws come into existence - whether that be a developer's precedent, a considered review of the scheme's requirements or an overly prescriptive collation of every possible by-law that has ever been prepared.
Getting the balance right is crucial, particularly in light of the BCCMA's requirements of what by-laws can and can't provide.
