Paternity Leave Rights in California | Shouse California Law Group Many employees are unaware that state law provides specific protections for fathers who want to take time off to bond with their child. Under the California Family Rights Act (CFRA), eligible employees can take up to 12 weeks of unpaid leave for bonding with a newborn, adopted child, or foster child. To qualify, you must have worked for your employer for at least a year, have 1,250 hours of service in the last 12 months, and work for an employer with at least five employees. While CFRA leave is unpaid, many fathers can receive partial wage replacement through California’s Paid Family Leave (PFL) program. Your employer cannot deny your request for paternity leave or retaliate against you for taking it. Additionally, they must reinstate you to your previous position when you return.
